These Terms and Conditions ("Terms") govern your access to and use of 99helpers ("the Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About 99helpers

99helpers is a file and web hosting service. You can put a file, a page or a whole static website online at an address on 99helpers.site or on your own domain, including pages and files made with AI tools such as Claude, ChatGPT and Gemini. The Service also includes:

AI features that create a website from a description you give ("Create with AI") and change a site when you describe what should be different ("Edit with AI");
an MCP server and a REST API, so AI apps you connect, and your own scripts, can publish and manage your sites;
site features such as forms, lead forms, a blog, drafts, password protection, custom domains, QR codes and visitor analytics;
free tools that can be used without an account, and related guides and support materials.

2. Eligibility

You must be at least 18 years old to use the Service. By using 99helpers, you represent that you are of legal age and have the authority to enter into these Terms on behalf of yourself or any organisation you represent.

3. Accounts

Registration

To publish with 99helpers you need an account, created with accurate and complete information. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

Workspaces

Sites, API tokens and connected apps belong to a workspace. Members of a workspace can manage its sites, and you are responsible for whom you invite to yours.

Account security

You must notify us immediately if you suspect unauthorised access to your account. We are not liable for any loss or damage arising from your failure to keep your credentials secure.

One account per person

Each account belongs to one person. You may not share your sign-in details or transfer your account to another party without our written consent. To work together, invite others to your workspace.

4. Plans, Subscriptions and Payment

Plans

99helpers offers a free plan and paid plans. The features and limits that apply to you, such as the number of projects, their size, monthly visits and form submissions, and access to custom domains, AI editing, the API and the MCP server, depend on your plan as described on our pricing page. Sites on the free plan show a small 99helpers badge. We may change plan features with reasonable notice.

Billing

Paid subscriptions are billed in advance on a monthly or annual basis, as selected at checkout. All fees are exclusive of applicable taxes, which are added where required by law.

Payment processing

Payments are processed securely by Stripe, Inc. By providing payment details you authorise us to charge your payment method for the subscription fees due.

Cancellation and refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. When a paid plan ends, your workspace moves to the free plan: sites stay online, but features and limits of the free plan apply, and you may not be able to add to or enlarge sites above those limits. We do not provide refunds for partially used billing periods except where required by applicable law.

Price changes

We may change subscription prices. We will give at least 30 days' notice of any price increase before it takes effect for existing subscribers.

5. Acceptable Use

What you may and may not host is set out in our Acceptable Use Policy, which forms part of these Terms. In addition, you must not use the Service to:

Violate any applicable local, national or international law or regulation.
Publish content that is illegal, defamatory, obscene, hateful, or infringes the rights of any third party, including copyright, trademarks and privacy.
Deceive, defraud or harm people, for example with phishing pages, fake sign-in or payment pages, or pages that impersonate another person or organisation.
Distribute malware, spam or unsolicited messages.
Harass, abuse or threaten any person.
Attempt to gain unauthorised access to any part of the Service, other users' sites or our infrastructure.
Circumvent usage limits, rate limits, content checks or other technical controls, including by creating new accounts after being removed.
Resell or sublicense access to the Service without our written permission.

6. Your Content

Ownership

You keep ownership of everything you publish or upload to 99helpers, including files, sites, blog posts and form configurations, and of the content our AI features create for you, to the extent the law allows ownership of it ("Your Content").

Licence to us

By publishing Your Content, you grant 99helpers a limited, non-exclusive, worldwide, royalty-free licence to store, copy, cache, process, display and serve Your Content, and to keep earlier versions of it, solely to provide, secure and improve the Service. This includes sending it to AI model providers when you use our AI features, and to apps you connect when they request it. We do not claim ownership of Your Content.

Public by default

Sites you publish can be seen by anyone with the address unless you protect them with a password or keep them as a draft. You are responsible for what you choose to make public.

Your responsibility

You are solely responsible for Your Content and for making sure it does not break any law or infringe anyone's rights. You must not publish content you do not have the right to use. If your sites collect personal data from visitors, for example through forms, you are responsible for doing so lawfully and for telling your visitors how you use it; we process that data on your behalf as described in our Privacy Policy.

Content checks and removal

Uploads are checked automatically for harmful content, and content may be held for review before it goes online. We may remove or disable access to any content, take a site offline, or suspend an account where we reasonably believe it breaks these Terms or the law, or puts people at risk, in line with our Acceptable Use Policy. Anyone can report content through our abuse page.

AI-generated content

Our AI features, and AI apps you connect, use AI models to create and change content. AI-generated content may be inaccurate, incomplete, inappropriate, or similar to existing material. Review what the AI produces before you publish or share it. You are responsible for the content you publish, whether you or an AI created it.

7. Connected Apps, API and MCP Server

You can let AI apps and scripts act on your workspace by connecting them through our MCP server (by signing in or with an API token) or by using our REST API.

You are responsible for everything a connected app or API token does with your workspace, including publishing, changing and deleting sites, and reading form submissions.
Keep API tokens secret. Revoke a token, or disconnect an app, in your dashboard if it is no longer needed or may have been exposed.
Connected apps are provided by third parties and are governed by their own terms and privacy policies.
We may limit how often the API and MCP server can be used, and change or retire API features with reasonable notice.

8. Intellectual Property

Our IP

All intellectual property rights in the 99helpers platform, including its software, design, templates, trademarks and documentation, belong to us or our licensors. These Terms do not transfer any ownership rights to you. Templates you copy to your own address may be changed and used for your own sites. Use of our name and logos is covered by our branding page.

Feedback

If you give us feedback, suggestions or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use them for any purpose without obligation to you.

9. Third-Party Services

The Service relies on and works with third-party services, including AI model providers, the AI apps you connect, Cloudflare (which stores and serves hosted content and provides certificates for custom domains), stock photo services such as Unsplash, and our payment processor. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

10. Free Tools

99helpers provides free tools that can be used without an account. They are provided "as is" for informational purposes. Results from free tools, including AI-generated results, should not be relied upon as professional advice.

11. Availability and Uptime

We aim to provide a reliable service but we do not guarantee uninterrupted availability. The Service, including hosted sites, may be temporarily unavailable due to maintenance, updates or circumstances beyond our control. We are not liable for any losses resulting from downtime or service interruptions. Keep your own copies of anything important you publish.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components. AI-generated content is not a substitute for professional legal, medical, financial or other specialist advice.

13. Limitation of Liability

To the maximum extent permitted by applicable law, 99helpers shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

14. Indemnification

You agree to indemnify and hold harmless 99helpers, its employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

15. Termination

By you

You may close your account at any time using the account deletion option in your settings, or by contacting us.

By us

We may suspend or terminate your account at any time if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. We will give reasonable notice where possible. Where an account is removed for a serious breach, we may take its sites offline and prevent its email address from being used for a new account.

Effect of termination

When your account ends, your right to use the Service ends immediately and your sites may be taken offline. Your data is handled in accordance with our Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date means you accept the updated Terms. If you do not agree to the changes, you may close your account before they take effect.

17. Governing Law and Disputes

These Terms are governed by the laws of Ireland and the European Union, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.

If you are a consumer in the EU, you may also refer disputes to the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

18. General

Entire agreement: these Terms, together with our Privacy Policy and Acceptable Use Policy, are the entire agreement between you and 99helpers regarding the Service.
Severability: if any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
No waiver: our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.
Assignment: you may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor in connection with a merger, acquisition or sale of assets.
